They might have uploaded it before Theymos decided to disable it.
If they will remove it and upload again, the animated avatar will not anymore reflect.

That is because they haven't changed it since it was disabled. The rule is you cannot upload NEW animated avatars. Those that have already uploaded can keep theirs, that is until they change it. Almost became a limited status symbol now.
